BreathBooster Terms of Service

1. General Information

These Terms of Service ("Terms") govern your access to and use of the services provided by BreathBooster, located at Hauptstraße 20, 74189 Weinsberg, Germany ("we," "us," or "BreathBooster").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Medical Disclaimer

BreathBooster provides guided breathing exercises and wellness content for general educational and recreational purposes only. We are not a licensed medical, psychological, or healthcare provider, and the Services do not constitute or substitute medical advice, diagnosis, or treatment.

Important: You must not use BreathBooster if you:

• Have any existing respiratory, cardiovascular, neurological, or psychiatric conditions
• Are pregnant or undergoing any medical treatment
• Experience dizziness, shortness of breath, anxiety, heart palpitations, or other physical or mental discomfort during breathing sessions

In these cases, stop using the app immediately and consult a qualified healthcare professional. Any reliance on the Services is strictly at your own risk.

3. Use of Services

Eligibility: You must be at least 18 years old to use the Services, or 16 years old with parental consent, unless your local laws require otherwise.

User Conduct: You agree not to misuse the Services, including by interfering with their normal operation, copying or reverse-engineering code, attempting unauthorized access, or using the Services for any illegal or abusive purpose.

License Grant: BreathBooster grants you a non-exclusive, non-transferable, revocable, limited license to use the Services for personal, non-commercial purposes.

4. Subscriptions & Billing

You may purchase subscriptions via the App Store or Google Play. Subscriptions automatically renew unless canceled via your store account.

Right of Withdrawal (EU Only): If you reside in the EU, you have a right to withdraw from your subscription purchase within 14 days. However, if you begin using BreathBooster Services before the withdrawal period ends, you waive this right.

Refund Policy: Refunds are handled by the App Store or Google Play and subject to their policies. BreathBooster does not issue direct refunds.

5. Privacy and Data

Your privacy is important to us. Please read our Privacy Policy for information on how we collect, use, store, and protect your data. By using BreathBooster, you consent to such data processing.

6. Intellectual Property

All content, logos, software, and branding are the property of BreathBooster or its licensors and protected under international copyright, trademark, and intellectual property laws. No rights are transferred to users.

7. Disclaimers & Limitation of Liability

Disclaimer: The Services are provided "as is" and "as available," without warranties of any kind. BreathBooster expressly disclaims all warranties, express or implied. We make no guarantees that using BreathBooster will achieve any specific outcome such as better sleep, reduced anxiety, or improved focus.

Limitation of Liability: To the fullest extent permitted by applicable law, BreathBooster, its affiliates, employees, licensors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your access or use of the Services, including but not limited to physical or psychological harm, medical or mental health deterioration, or data loss.

Our total liability in any matter arising out of or related to these Terms is limited to the amount you paid (if any) to use the Services in the six (6) months prior to the claim.

8. Dispute Resolution

This agreement is governed by the laws of Germany, excluding conflict of law rules. For EU residents, consumer rights under local laws remain unaffected.

For U.S. users: You agree to resolve any dispute individually through binding arbitration and waive your right to join class actions.

10. Children's Data

BreathBooster is not directed to children under 18 years of age. We do not knowingly collect data from anyone under the age of 18. If you believe a child has provided data without parental consent, contact us and we will delete it.
