General Information

These Terms of Service ("Terms") govern your access to and use of the services provided by Now! Focus and Timer, located at Hauptstraße 20, 74189 Weinsberg, Germany ("we," "us," or "Now! Focus and Timer").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 16 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.

2. Nature of the App

The App provides:

  • Breathing exercises
  • Focus timers
  • Mindfulness and relaxation routines
  • Wellness and habit-related guidance
  • Goal-tracking and reflection tools

The App does NOT provide medical advice, diagnosis, or treatment. Always consult a medical professional before starting breathing, meditation, or physical routines.

3. Health Disclaimer

By using the App, you acknowledge the following:

  • Breathing, focus, or mindfulness exercises can affect your heart rate, stress level, and mental state.
  • Stop immediately if you feel discomfort, dizziness, shortness of breath, chest pain, or anxiety.
  • Do not use the App while driving, operating machinery, or performing activities requiring full attention.
  • You are solely responsible for evaluating and managing your health risks.

The App is NOT intended for:

  • Individuals with cardiovascular issues
  • Individuals with respiratory disorders
  • Individuals diagnosed with anxiety, panic disorders, or neurological conditions
  • Pregnant individuals (unless cleared by a medical professional)

4. Not Medical Advice

Nothing in the App constitutes medical, psychiatric, or therapeutic advice. Information may be incomplete or general. Always consult a doctor for health questions. Your use is at your own risk.

5. User Accounts

To access certain features, you may need to create an account. You agree to:

  • Provide accurate information
  • Keep your login credentials secure
  • Not share your account
  • Accept responsibility for all activity linked to your account

We may suspend or terminate your account if you violate these Terms.

6. Subscription, Payments, and Billing

Some features require a paid subscription or one-time purchase. You agree that:

  • All purchases are final unless required by law.
  • Subscriptions renew automatically unless canceled at least 24 hours before renewal.
  • Payment is processed through the App Store or Google Play.

Price changes may occur. You will be notified where required by law.

7. License & Acceptable Use

We grant you a limited, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may NOT:

  • Modify, reverse engineer, or copy the App
  • Mine data or scrape the App
  • Use it for commercial or resale purposes
  • Interfere with App functionality
  • Upload viruses, harmful code, or malicious content

8. Content & Intellectual Property

All content—including breathing instructions, audio, UI, graphics, timers, trademarks, and brand names—is owned by us or licensed to us. You may not reproduce, distribute, sell, or publicly display any content without permission.

9. User-Generated Content

If the App allows user submissions (notes, reflections, goals, comments), you agree that:

  • You own your content
  • You grant us a license to store, display, process, and back up your content
  • You will not upload illegal, offensive, or harmful material

We may remove content that violates these Terms.

10. Data & Privacy

Your use of the App is governed by our Privacy Policy, covering:

  • Data collection
  • Data processing
  • Cookies and analytics
  • Third-party providers
  • Data retention
  • User rights (GDPR, CCPA, global compliance)

11. Third-Party Services

The App may integrate third-party services (analytics, payments, cloud syncing, authentication). We are not responsible for:

  • Third-party terms
  • Third-party privacy practices
  • Availability or accuracy of third-party services

You use them at your own risk.

12. Availability & Updates

We do not guarantee:

  • The App will always be available
  • The App will be bug-free
  • Data will never be lost

We may update, suspend, modify, or discontinue features at any time.

13. Termination

We may suspend or terminate your access if you violate these Terms, misuse the App, or if we discontinue the App or features. You may delete your account at any time.

14. Disclaimers & Limitation of Liability

We provide the App “AS IS” and “AS AVAILABLE.”

  • No warranties, expressed or implied
  • No guarantee of results from breathing or mindfulness exercises
  • Not liable for physical, mental, emotional, or health-related outcomes
  • Not responsible for data loss or interruptions
  • Not liable for injuries, panic responses, or improper use
  • Not liable for indirect, incidental, or consequential damages

Your sole remedy is to stop using the App.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates from claims arising from your:

  • Use or misuse of the App
  • Violation of these Terms
  • Violation of applicable laws
  • Infringement of rights

16. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles.

17. Dispute Resolution

Disputes will first be attempted to resolve through informal negotiation. If unresolved, disputes will be handled under the jurisdiction of Stuttgart, Germany, unless local consumer laws require otherwise.

18. Changes to the Terms

We may update these Terms. Continued use of the App constitutes acceptance of the changes.
